U.S. charges man with stealing software from NY Fed (Reuters)

NEW YORK (Reuters) ? U.S. prosectors charged a computer programmer with stealing software code valued at nearly $10 million from the Federal Reserve Bank of New York.

They charged Bo Zhang, who worked as a contract programmer at the bank, with illegally copying software to an external hard drive, according to a criminal complaint filed in U.S. District court on Wednesday.

Both the New York Fed and the Federal Reserve Board in Washington declined requests for comment.

Authorities said the software, owned by the U.S. Treasury Department, cost about $9.5 million to develop.

It was not immediately clear if Zhang was in custody. But the complaint, signed by an FBI agent, said Zhang had admitted to copying the code onto a drive and taking it back to his home.

Zhang told investigators he took the code "for private use and in order to ensure that it was available to him in the event that he lost his job," the complaint said.

Zhang was hired as a contract employee in May by an unnamed technology consulting company hired by the Fed to work on its computers, the complaint said.

It appears that investigators uncovered the suspected breach only after one of Zhang's colleagues told a supervisor that Zhang had claimed to have lost a hard drive containing the code, the complaint said.

Leap second lives on, at least another week

(AP) ? The leap second may live on for at least another three years.

Once or twice a year, the leap second can be tacked on to synchronize atomic clocks ? the world's scientific timekeepers ? with the Earth's rotational cycle, which does not run quite like clockwork.

Without the leap second, atomic clocks would diverge about a minute a century from the course of the sun across the sky.

Britain, China, Canada and others have argued to keep it, but the United States, France and other nations have pushed to untether machines from the natural cycle because of the technical difficulties and costs to government and business.

Sanjay Acharya, a spokesman for the International Telecommunication Union, said Thursday a decision to abolish the leap second has been put off until next week. He said "it's been deferred" because government delegates at an ITU meeting were unable to reach agreement at talks this week.

The decision about how much the world needs the leap second affects everything from mobile phone networks to financial markets to air traffic control systems, all of which rely on atomic clocks and wouldn't have to momentarily stop their systems.

A Paris-based agency that tracks the globe's irregular wobble sends notice when the world's timekeepers need to add a leap second. That's only done on June 30 and December 31, but sometimes years go by without an adjustment ? and there's never been the need to subtract a leap second.

Government delegates now plan to examine the issue at a separate meeting in Geneva next week, but Acharya said they will likely defer any formal decision until 2015.

Snakes, Fort Benning to Hold Military Hockey Tryouts Today

COLUMBUS, GA - The Columbus Cottonmouths, in conjunction with Fort Benning, will host tryouts today and next Thursday, Jan. 19 from 7:00 to 8:00 pm in the Columbus Ice Rink to assemble a Fort Benning hockey team.

Tryouts are open to all active duty military and participants must provide their own equipment. A very limited supply of equipment will be available for purchase at the rink. Tryouts will consist of drills and scrimmages being run by Cottonmouths head coach Jerome 'Boom Boom' Bechard, with 22-24 people being selected for the team.

Saturday, Feb. 11 is Military Appreciation Night and the conclusion of Legends Weekend. Fort Benning's newly-assembled team will face the Cottonmouths Legends at 6 p.m., prior to the Cottonmouths' regularly scheduled game. One ticket gets fans into both events.

Approximately 20 former Snakes will return to the Snake Pit for Legends Weekend. Included in the list of returning players are enforcer and fan-favorite Dan Leslie (2007-10), Cottonmouths all-time leading scorer Tim 'The Toolman' Green (2004-10), goaltender from the 1997-98 Levin's Cup championship team Frankie 'The Wall' Ouellette (1997-2001) and playoff MVP from the 97-98 championship team Mike Martens (1997-2001). A complete list of returning Legends will be released soon.

Steven Spielberg Talks Labor Of Love Project 'Smash' (omg!)

The cast of NBC's 'Smash' -- NBC

Steven Spielberg is bringing the ambitious behind-the-scenes-of-Broadway drama "Smash" to NBC and the television series really is a labor of love for the filmmaking legend.

"I came up with the idea for the series," Steven told Access Hollywood's Billy Bush at Sunday night's Golden Globes, where his movie, "The Adventures of Tintin," won Best Animated Feature.

"I'd been flogging it for about five years," Steven continued of "Smash." "It took [NBC's entertainment president] Bob Greenblatt to step forward, because he's done musical theater with '9 to 5.' He really responded to the material."

The legendary director and producer said that although he was behind the series, which stars Anjelica Huston, Debra Messing and former "American Idol" runner-up Katharine McPhee, the NBC boss was the only one who realized the show had value.

"I couldn't get anybody else to buy it. Bob stepped forward and took the show for NBC," Steven added. "So, I hired myself and my... two TV partners at DreamWorks Television... We then hired Theresa Rebeck to really create the show. She wrote a wonderful play called, 'The Understudy.' She had done a lot of writing for theater and I wanted theater. I wanted writers from theater to write about theater."

While the name Steven Spielberg can drum up fan interest in a project, he said he sometimes keeps his name from use in promotional materials for programs.

"Do you ever say, can you please take my name down?" Billy asked.

"I do. I do. I limit the use of the name on all of the billboards out there when I'm doing television and I limit it was much as I possibly can because it just... I get tired of seeing my own name," he laughed.

But not with "Smash." The project proudly bares its top boss' name on the posters.

"Smash" premieres on NBC Monday, February 6, at 10 PM ET/PT, and, beginning Monday, the pilot episode is available on NBC's Video on Demand partners, including its parent company, Comcast.

German investor sentiment rises in Jan (AP)

BERLIN ? German investor sentiment rose strongly in January, indicating that economic activity in the country should stabilize over the next six months rather than deteriorate further, a closely watched survey showed Tuesday.

The ZEW investor sentiment index for January rose 32.2 points in January, to minus 21.6 points overall. The rise puts the indicator at its highest level since last July, though ZEW noted it is still well below its historical average of plus 24.5 points.

The survey, which polled 293 analysts and institutional investors from January 2 to January 16 about their medium-term expectations, also saw a 21.6 point rise in economic sentiment toward the 17-nation eurozone, taking the index to minus 32.5 points.

In addition to suggesting that investors expect the German economy to stabilize over the next half year, ZEW said that improved economic data from the United States as well as recent declines in yields from Spanish and Italian bonds may have contributed to the increase.

Even though the government reported in the middle of the survey period that the German economy had likely contracted by 0.25 percent during the last quarter of 2011, the poll also posted a 1.6 point rise in investors' assessment of the current situation in the country, for a 28.4 overall rating.

The investors assessment of the eurozone's current situation dropped 7.7 points, however, to minus 51.8 points overall.

Though there have been fears that the German economy would follow the downward trend of other eurozone nations, ING Global Research economist Carsten Brzeski said the survey indicates "the trough of negativity might be behind."

In fact, he said, Germany may be set to benefit from the weakness of its neighbors.

"With more than 60 percent of all exports going into non-eurozone countries, Germany is among the main beneficiaries of the recent euro weakness," he said. "Moreover, the latest downgrades of nine eurozone countries have rather strengthened than weakened Germany's safe haven role, keeping government bond yields at record lows."

Shiite pilgrims defy bombings in Iraq to mark Arbaeen

Shiite pilgrims rely on the kindness of Shiites and even some Sunnis who set up hospitality tents along the road to the holy city of Karbala. Both pilgrims and volunteers say they won't be stopped by the risk of violence.

Millions of Shiite Muslim pilgrims, intent on carrying out a commemoration denied to them here for decades, are defying ongoing bombings to converge on the holy city of Karbala.

Most of the pilgrims are in plastic sandals ? some with only tape holding them together ? during the three-day walk from Baghdad. Some push friends or relatives in wheelchairs and carry small children. A few wrap themselves in the white shrouds they want to be buried in if they die on the way.

Carrying nothing, they rely on the kindness of Shiites and some Sunnis who set up hospitality tents along the way providing food, medical treatment, and a place to rest ? despite the risk posed by terrorist attacks.

?They want to stop us from serving the pilgrims but we won?t be stopped,? says volunteer Jafar Ghazi Mohammad, who lost his mother Saniya Hassan two years ago in the single worst attack on pilgrims, which took place on the northern outskirts of Baghdad. She had volunteered to search women entering the women?s tent.

?We?re much stronger than them. No matter what they do we?re stronger,? says Mr. Mohammad.

Distributing oranges from the basket of his bicycle, he and others say they were undaunted by six roadside bombs dismantled by police this week just a few hundred yards from their tent. Police officers, who asked that their names not be used, said the bombs were disguised in bricks and scattered on the gravel near the highway. A seventh exploded, damaging a minibus but causing no casualties.

Pilgrims remember those killed

Dozens of Iraqis have been killed so far in bombings targeting the hundreds of thousands of pilgrims thronging roads leading to southern Iraqi city where Imam Hussein, grandson of the prophet Muhammad, was killed in battle by fellow Muslims in 680 A.D. ? a battle in which today's Sunni-Shiite split is rooted.

Iraqi authorities expect several million pilgrims to have arrived in Karbala by Saturday for Arbaeen ? the 40th?day of mourning. More than 30,000 Iraqi police and soldiers have been deployed to Karbala for the first such commemoration since US troops withdrew from Iraq last month.

A roadside shrine

Just inside Baghdad?s northern city limits, many of the pilgrims walking from as far as Iraqi Kurdistan stop at a small roadside shrine marking the site of the single worst attack on pilgrims two years ago.

Under the green concrete dome, Assawar Assam says the prayer for the dead for her school friend Shaima Haider and then leans over the shrine draped with green satin to kiss her photo.

?She was with us in fourth grade,? says Assawar, who stops every time she passes the shrine. ?She was very kind. She liked to help the poor, she liked to help everyone.?

It was at one of the hospitality tents here that Maitham Mohammad Dhahr saw a lone, middle-aged woman cross the highway near the village of Boub al-Sham.

Chaz Bono ready to date as a single man

Just before the holidays, Chaz Bono called off his engagement?to fiancee Jennifer Elias, and now the onetime "Dancing With the Stars" contender is saying that he's ready to date, for the first time as a single man.

"What a great skill: to be able to take a woman dancing ... and actually know what you're doing," Bono told People magazineof hopes to take his newfound dancing skills to the dating scene.

Since his split with Elias, Bono's been working on staying fit, the magazine reports. He's been skiing, and has taken up boxing. Meanwhile, he's given lots of thought to what it will be like to date as a trans man. "People focus on what's between your legs," Bono told People. "If I never have bottom surgery [the procedure by which a penis is created], I'm fine. I feel 100 percent male as I am."

5 Predictions for Online Data in 2012 (Mashable)

Jones-Dilworth, Inc., a public relations consultancy focused on bringing early-stage technologies to market. In the spirit of the new year, I've determined my online data predictions for 2012. And because I'm attempting to make this an annual experiment, let?s begin my looking back at how my 2011 predictions shook out.

1. Personal data management matures into an industry. I?ll admit the prediction was largely a fail. Ambitious startups like Singly + The Locker Project got off the ground, but did not pick up steam. Many new, related startups are in the works, but none have even come close to the goal of managing one's data the way he manages his health or wealth, for instance. An end-to-end platform may emerge, but it will take time.

2. The flood gates of corporate data open widely. This prediction has come close to being true. It certainly has become important to mine, parse and manifest corporate data for internal and external uses alike. The predominant question has indeed shifted from ?Should I make my data open and available?? to ?How can I do it best?" But at the same time, a lot of people are still sitting on the sidelines, waiting to see how things develop.

3. Big data gets regulated. Facebook agreed to submit to independent privacy audits as part of its long-gestating FTC settlement. I?d argue that we?ll see more regulation in 2012. Congress has taken an active role, and the big Internet companies have only further increased their lobbying spend. Controversies surrounding Carrier IQ, Apple and SOPA have accelerated public interest.

Of course there?s good regulation and bad regulation. Anyone doing business in or with data is going to have to understand how government works, and play an active role.

4. The trend itself gets old and tired. Another outright fail. It is certainly true that everything is becoming, or has already become, data-driven, but we haven?t yet had the hangover I predicted. If anything, we?re full-steam ahead, and as ebullient and ambitious as ever.

This is good and bad -- escalating investment of both human and real capital will spur innovation and speed up the inevitable. But the pace also makes us more vulnerable. Data for data?s sake, or data for self-justification is an ongoing risk.

5. Data scientists become the new community managers. I think it?s fair to say that this happened, by a large margin. Check out this chart from Indeed that chronicles the explosion of data scientist jobs. CMSWire explores the particulars in more detail.

Last year aside, what?s going to matter in 2012?


1. Future Tense Analytics -- Hello, McFly?


For a long time, were analytics defined by the past -- what happened a day ago? A week ago? A year ago?

The arrival of real-time technologies sped things up quite a bit. It?s now commonplace to ask, what?s happening? What?s trending? What?s changing? Today?s best data-driven technologies and strategies orchestrate insights in the present tense.

Naturally, predictive analytics tackle the future tense. This isn?t a new notion, but the underlying technologies are finally mature enough for predictive use. Keep an eye on places like Decide.com. In 2012, future-tense capabilities will become widespread, and in high demand.


2. Mixing and Matching Data Sets


One of the things that comes right after wider availability of data is the desire to put that data in context. For instance, this type of mashup culture is what put Mashable itself on the map back in 2006 and 2007. For other brands and enterprises, 2012 will be all about crashing diverse data sets together, and seeing what clicks.

I?m actually a dissenter when it comes to companies like Factual or SimpleGeo?s heavy emphasis on location as a single data vertical. BlueKai's ad targeting are other examples of early leaders in a particular domain.

It?s not at all that these companies aren?t cool or useful, but the most interesting things happen when you mash up data sources. For example, Umbel can provide incredible insight into your audience and its habits, but it?s even more interesting when merged with usage logs, comment streams and share counts.

The year 2012 will be about putting corporate data alongside open public sources -- internal data meets external data.

This is why I continue to be a big fan of data marketplaces like Infochimps, a company I advise, which has bundled data sets and API surrounding key themes, instead of verticals. The most actionable insights come from a diversity of data.


3. The Data Scientist Talent Grab


A few years ago, I remember reading job descriptions for Ruby on Rails programmers who should have ?5+ years of experience.? This was funny, as Rails was only three years old at the time.

That is what happens when a certain skill set spikes in demand. Employers assume market maturity when there is none, hiring gets very competitive, salaries rise, the very best practitioners give their employers an unfair advantage, and the market is flooded with wannabes (some of whom prove their mettle, some who do not).

Training and professional development initiatives have taken center stage, and the land grab is on. McKinsey predicts that by 2018, the U.S. alone will face a 140,000 to 190,000-person shortage of professionals who have deep analytical skills, as well as a shortfall of 1.5 million managers and analysts with the know-how to analyze big data to make effective decisions.

We?re even seeing venture firms like Greylock hire top 5% data scientists to work across the entire portfolio, as one solution to the problem. And companies are employing new means of data science outsourcing (see: Kaggle, Mu Sigma).

Since it?s all still a relatively nascent field, I urge you to reinvest in the talent you already house. Knowledge of your own business is just as important as knowledge of data science. There are requisite skills of course, and it takes a certain kind of person, but in my own experience, there are bound to be many qualified individuals who are hungry and game.

Soon there will be a much wider gap between the novices and the experts. However, don?t think of data science chops as just something you can hire for, and be done with. It?s a transformative trend, something that will eventually cut horizontally across your entire organization.

In 2012, data science will appear in job descriptions left and right, and will become the most in-demand skill set in the technology sector.


4. Data-Driven Everywhere


We generally think of data as the domain of large B2B companies that sell enterprise software, or of advertising networks and targeting systems that have an easy way of assigning a dollar value to their work. But the legal, pharma and law enforcement sectors have also been natural fits.

In 2012, we?ll see data-driven innovation and data-centric design emerge from the unlikeliest of places -- think data-driven fashion, crop insurance, Hollywood box office and even humanities education.

Essentially, don't rule out the possibility of data-driven strategies anywhere. Even if a business doesn?t run on data, it absolutely produces very interesting exhaust that can be used advantageously.


5. Data-Driven Non-profits


Data has a higher purpose too --- it?s not just a pageview multiplier, or a CPM lift. ?Data can help us understand how we are doing as a society and as a culture.

Here I?m not talking about non-profits that use data to grow. I?m talking about non-profit initiatives that are built around data in and of themselves. Two great examples are CommonCrawl and the Earth Dashboard Project. Common Crawl builds and maintains a free and open crawl of the web and all its data, with the purpose of forwarding important research that requires large-scale analysis. The Earth Dashboard Project is an effort to build a living report card of sorts for the entire globe. It will be installed at the UN Headquarters in New York City as a way of reminding delegates and visitors of the bigger picture, our interconnectedness, and what we?re really working toward every day.

There is a lot to be done with data, not nearly all of it profitable. In 2012, we?ll see five to seven new data-driven non-profits start to bite off important chunks of value that sit outside of corporate and governmental concerns.

Texas firm to build ethane pipeline from Pa. to Gulf

DALLAS -- Enterprise Products Partners LP, the largest U.S. pipeline partnership by market value, said Tuesday it will build a 1,230-mile line to ship ethane from southwestern Pennsylvania to Gulf Coast petrochemical plants.

The ATEX line will connect the Marcellus and Utica Shale formations in Pennsylvania, West Virginia and Ohio with ethylene plants on the Gulf Coast. Its first leg will run 595 miles from Washington County to Cape Girardeau, Mo. From there, the company will use existing pipeline to connect with its natural gas liquids storage complex at Mont Belvieu, Texas.

Enterprise said it is negotiating right-of-way agreements and expects to begin operating the pipeline in the first quarter of 2014. The company said the project would create about 4,000 jobs during and after construction.

The ATEX Express pipeline will have the capacity to transport as much as 190,000 barrels a day, Houston-based Enterprise said in a statement Tuesday. The company has commitments from shippers to pay 14.5 to 15.5 cents per gallon. If the pipeline reaches its full capacity, it may generate more than $400 million a year in revenue, according to Bloomberg News calculations. The release didn't say how much of the capacity is committed to shippers.

Chemical companies, including Dow Chemical Co. and LyondellBassell Industries NV, are using more ethane and other natural-gas liquids from shale formations as a way to replace crude oil-based feedstocks, such as naphtha. Enterprise estimates that Gulf Coast petrochemical demand for ethane is about 955,000 barrels a day, according to the statement. Ethane is a feedstock for producing ethylene, the main ingredient in plastics.

"The willingness of shippers to commit to a term of at least 15 years reflects the long-term potential of shale development in the Appalachian region," Enterprise chief executive officer Michael A. Creel said in the statement.

"Enterprise has garnered the most shipper interest and, at this point, is the only pipeline solution that goes from the Marcellus Shale down to Texas," T.J. Schultz, an analyst with RBC Capital Markets in Austin, said in a phone interview. Mr. Schultz rates Enterprise's units at "outperform" and owns none.

Enterprise's Mont Belvieu complex is the biggest storage and processing facility for ethane and other gas liquids on the Gulf Coast, said Darren Horowitz, an analyst for Raymond James & Associates Inc. in Houston. He said it is connected to almost every petrochemical facility on the Gulf.

"Producers want a complete solution, and they're willing to pay more for access," said Mr. Horowitz, who rates Enterprise's units a "strong buy" and owns none.

Enterprise rose 29 cents, or less than 1 percent, to close Tuesday at $46.67 in New York.

App developers unite! Or at least organize yourselves a bit better

It's only right that the creative individuals behind a multi-billion dollar industry should have access to their own professional body, but for some reason the idea has yet to take hold. That could change at CES, when Jon Potter -- formerly of the Digital Media Association -- will start selling membership to a new outfit called the Application Developers Alliance. His pitch will open with the concept that "there's an interesting space in the application developer community that isn't really organized" and then move on to offer services like an online collaborative network, shared product-testing facilities, discount training schemes and cloud services, and even government lobbying over issues like privacy and IP. Critics assail crime laws aimed at people with HIV

A man in Texas is serving a 35-year prison sentence for spitting at a police officer ? because he has the virus that causes AIDS and his saliva was deemed a deadly weapon. In Michigan, an HIV-positive man who allegedly bit a neighbor during an argument faced a bioterrorism charge.

Charges for the same acts would have been far less severe if the defendants had been virus-free. Now, a coalition of advocacy groups ? backed by an outspoken champion in Congress ? is ratcheting up a campaign to press for review and possible repeal of criminal statutes specifically targeting HIV-positive people.

"These laws are archaic," said Rep. Barbara Lee, D-Calif. "They're criminalizing a population of people who should not be criminalized."

Lee introduced a bill in September that would provide states with incentives and support to reform criminal laws aimed at people with HIV. Lee assumes the bill has little chance of passage while Republicans control the House, but hopes it will help raise awareness about the state laws.

"It's very important to start these debates, to get governors and legislators to look at it," she said in a telephone interview.

Thirty-four states have criminal laws that punish people for exposing another person to HIV, according to the advocacy groups working with Lee. Prosecutions occur even in the absence of actual HIV transmission, and the laws generally do not consider use of a condom as a defense, the groups said.

Many of the laws were enacted early in the AIDS epidemic, when fear of the disease's deadliness was at its highest and before advances in understanding how HIV was transmitted. The laws have not been revised even though AIDS ? thanks to the development of medication regimens ? is no longer viewed as a death sentence.

Scott Burns, executive director of the National District Attorney's Association, suggested that most prosecutors would oppose Lee's bill and argue that the laws remain necessary to deter HIV-positive people from reckless or irresponsible behavior.

"Notwithstanding that we've made tremendous medical advances, I don't know anyone who'd want to be infected with HIV and go through the treatment regimen," he said.

According to the Centers for Disease Control, HIV is spread primarily by unprotected sex with an HIV-positive person, sharing of tainted needles or syringes, and births by an HIV-infected mother.

HIV is not spread by saliva, tears or sweat, and there are no documented cases of it being transmitted by spitting, according to the CDC. As for biting, the CDC says there is no transmission risk if the skin is not broken; in a "very small number of cases," transmission did occur when a bite drew blood and caused severe tissue damage.

While prosecutors defend the HIV laws as appropriate for certain cases, some activists argue that criminalization of exposure to HIV can backfire and actually fuel the spread of the disease.

They note that under most of the state laws, people who don't know they have HIV are less culpable than those who do know. This fact could deter some people from learning their HIV status, and thus preclude some HIV-positive people from getting treatment.

A better approach, the advocates say, is to encourage responsibility and disclosure without the underlying threat of arrest and prosecution.

The Obama administration's National AIDS Strategy, released in July 2010, echoes those concerns, saying some of the state laws "may make people less willing to disclose their status by making people feel at even greater risk of discrimination."

"It may be appropriate for legislators to reconsider whether existing laws continue to further the public interest," the strategy says. "In many instances, the continued existence and enforcement of these types of laws run counter to scientific evidence."

Advocates for changes in the laws say many people have served long prison terms and been forced to register as sex offenders for conduct that posed no meaningful risk of HIV transmission. Catherine Hanssens of the Center for HIV Law and Policy, one of the key groups in the advocacy coalition, blames the longevity of the laws on "a seemingly invincible ignorance" about transmission.

Annual surveys by the Kaiser Family Foundation have documented this phenomenon. According to this year's survey, 1 in 3 Americans has a basic misunderstanding about HIV transmission ? believing, for example, that one can get HIV from sharing a drinking glass or swimming in a pool with someone with HIV.

"We need to educate people," Hanssens said. "Before we change the laws, we have to change their minds."

As part of an initiative called the Positive Justice Project, Hanssens' center recently documented scores of cases since 2008 in which people were prosecuted on charges specifically related to being HIV-positive.

Among the cases:

?In March 2010, an HIV-positive man in Michigan faced bioterrorism charges of using HIV as a weapon after he allegedly bit a neighbor on the lip during an argument. Three months later, a judge threw out that charge; the defendant, Daniel Allen, was placed on 11 months of probation for assault.

?In Iowa, an HIV-positive man, Nick Rhoades, received a 25-year sentence in 2009 for failing to disclose his HIV status prior to a one-time consensual sexual encounter during which the virus was not transmitted. Rhoades' sentence was eventually suspended, but he was nonetheless required to register as a sex offender.

?In 2008, a homeless man with HIV, Willie Campbell, received a 35-year sentence for spitting at a Dallas police officer because under Texas law his saliva was considered a deadly weapon. Local health officials said the risk of HIV transmission from saliva was extremely low, but the prosecutor in the case said the tough sentence was warranted.

"No matter how minuscule, there is some risk," said Jenni Morse. "That means there is the possibility of causing serious bodily injury or death."

In Ohio, there have been several recent cases of people being charged with felonious assault under an 11-year-old state law making it a crime for anyone diagnosed with HIV or AIDS to have sex without disclosing that status to their partner. The law applies regardless of whether HIV is transmitted.

"If you participate in any sex act, no matter how major or minor, you must tell your partner you are HIV-positive before having sex ? even if you are practicing safer sex!" warns a fact sheet distributed by Ohio health groups.

In an ongoing case in Cincinnati, former professional wrestler Andre Davis faces the possibility of decades in prison after being convicted in November of 14 counts of assault for having sex with women without telling them he'd tested positive for HIV. His sentencing is set for Jan. 6.

In accordance with the judge's instructions, it was never established at the trial whether any of the women actually became infected with HIV through contact with Davis, whose wrestling stage names included "Gangsta of Love."

Davis' attorney, Greg Cohen, said the law regarding HIV and felonious assault is "fear-based" and flawed because it doesn't require proof that there was any attempt to cause harm. He has said he may file an appeal.

"You can't just assume someone intended to harm someone else just by sleeping with them," Cohen said in a telephone interview.

However, prosecutor Amy Tranter, in closing arguments at last month's trial, said Davis should go to prison for a long time.

"He's shown no remorse, no responsibility for anything that he's done," she said.

William McColl, political director of the Washington-based advocacy group AIDS United, believes criminal prosecutions should be avoided in HIV-related cases except possibly for the rare instances when an HIV-positive person deliberately seeks to transmit the virus to someone else.

In the more common cases where an HIV-positive sexual partner had no malicious intent and there is a dispute about whether the HIV status was disclosed, prosecution is probably inappropriate, McColl said.

Advocacy groups recommend that people with HIV ? to guard themselves against prosecution ? should find ways to document that they disclosed their status to sexual partners. This could entail making a video of a disclosure conversation, having the partner sign a letter confirming the disclosure, or having the partner join in a discussion with a health professional.

"When you are in love, or in the heat of the moment, it may seem impossible to do any of these things," advises the Positive Justice Project. "But remember that these are the tools that may help you fight an arrest or conviction."

For advocacy groups working on behalf of HIV-positive people, the criminalization laws represent a negative side of a mixed picture. Overall, activists are heartened by progress in combatting HIV-related discrimination, whether by private employers or the federal government.

However, everyday discrimination does persist despite the Americans with Disabilities Act, which extends its anti-discrimination protections to people with HIV. In Pennsylvania, for example, a 13-year-old boy recently was denied admission to a private school because he is HIV-positive.

Priest accused of sex abuse honored at Marine Park church?s tree lighting

A Marine Park Catholic church dedicated its Christmas display to a priest accused of sex abuse, drawing outrage from one of his his alleged victim?s family.

Msgr. Thomas Brady, 78, a retired pastor at Good Shepherd Church, was placed on administrative leave after he was charged in October with attempting a "criminal sex act" on two teenage boys - but officials at the church still dedicated their annual tree lighting to him and posted a sign in his honor in front of the church.

The sign, still posted Monday, says the tree lighting ?is dedicated to Monsignor Thomas F. Brady for his Service to and Love for the People of Good Shepherd.?

The dad of a then 13-year-old boy who accused Brady of molesting him in the church rectory said he was furious to see the display at the church, where his family are longtime parishioners and his son attends the parish school.

?That?s a slap in the face,? he said. ?Take it down. That?s hurtful. You?re gaining support for Brady, but what about the victims??

Many parishioners have backed Brady, who was pastor at the church for more than 20 years before retiring in 2009 and was also a chaplain for the Fire Department, and insisted the accusations couldn?t be true. The priest has suffered several strokes and is battling lung cancer.

Pastor James Devlin declined to discuss why the tree was dedicated to the accused priest, saying, ?I don?t have any comment on that.?

The victim, now 14, who is still a student at Good Shepherd Parochial School, was shocked when he read the sign, according to his father.

?He even asked me, ?Dad, if this guy attacked me, why would they dedicate a tree to him??? he said. ?It?s outrageous.?

The sex abuse case is being handled by Staten Island prosecutors because Brady and Brooklyn District Attorney Charles Hynes have known each other for years. The family is pushing for a quick indictment. ?I just want justice for my son,? he said.

Family friend Mary Ann Moran, 54, said although Monsignor Brady performed her mother?s funeral and she appreciated his efforts to unite the neighborhood after Sept. 11, she was angry he would be honored after the accusations came to light. ?I understand how we feel so connected to the priest,? she said. ?In any other job or organization, someone who?s been arrested for sexually abusing a child would never be honored just for doing their job.?

North Korea says names Kim Jong-un top military commander (Reuters)

SEOUL (Reuters) ? North Korea announced on Saturday it has appointed Kim Jong-un, the anointed successor and youngest son of Kim Jong-il, as supreme commander of its 1.2 million-strong military, two days after official mourning for the late leader ended.

The North's state news agency KCNA said the appointment was made at a meeting of the Political Bureau of the Central Committee of the ruling Workers' Party on Friday.

KCNA said the Political Bureau members "courteously proclaimed the dear comrade Kim Jong-un, vice-chairman of the Central Military Commission of the Workers' Party of Korea, assumed the supreme commandership of the Korean People's Army," according to a will made by Kim Jong-il on October 8.

It did not elaborate on the will.

Since Kim Jong-il's death on December 17, the North's state media have dubbed Kim Jong-un "supreme commander." Some Korea-watchers say it may take Kim Jong-un some months to assume the full panoply of official titles held by his father.

But the announcement of the politburo's decision not only meant official approval of his control of one of the world's most powerful armed forces but also indicated the consolidation of his power could be much faster than expected.

Footage aired recently by the North's state TV has shown Kim Jong-un, believed to be in his 20s, flanked or followed by the North's top military officers and a coterie of leaders during a series of mourning ceremonies for his father.

This signaled a smooth transfer of power to Kim Jong-un, the third generation of his family to rule the unpredictable and reclusive communist state since shortly after World War Two.

"Faced with the sudden death of his father, Kim Jong-un and his supporters, who appear to be less prepared and insecure, may think they do not have much time in solidifying the young Kim's position," Professor Koh Yu-hwan, an expert on the North's leadership from Seoul's Dongguk University, told Reuters.

"The approval (of his supreme leadership of the military) should be one of the fastest ways to allow him the sovereign ruler position," Koh said. This ties in with the North's "military-first" policies on which Kim Jong-il relied heavily.

Kim Jong-un was named a four-star general and given the vice-chairmanship of the ruling party's Central Military Commission by his father in 2010.

Many Korea-watchers also expect the inexperienced new leader, who had only been groomed for rule since 2009, to lead with the aid of a close coterie around him that includes his uncle and key power-broker, Jang Song-thaek, at least in the early stages of the power transition.

Jang, husband of Kim Jong-il's younger sister, Kim Kyong-hui, stood behind his nephew in Wednesday's mass funeral parade, escorting the hearse carrying Kim's body.

Despite Pyongyang's determination to project an unbroken line from Kim Jong-un's iron-fisted predecessors, which began with his grandfather, Kim Il-sung, there have been questions among outsiders about his capacity to lead the country.

North Korea, whose military is pursuing a nuclear arms program, is technically still at war with the South and is suffering from chronic food shortages.

Labeling its opponents "foolish," North Korea warned the South on Friday it would stick to its hardline policies and said

Pyongyang would never engage with the current government of South Korea.

As Bills receiver Stevie Johnson approaches the final 60 minutes of his rookie contract, the question of whether he?ll remain with the team soon will become an even hotter topic in one of the league?s coldest climates.

Joe Buscaglia of WGR radio in Buffalo reports that Johnson asked for a contract worth $7.5 million per year during negotiations with the team.? Per Buscaglia, the Bills have made no offers during the past month.

In September, Buscaglia reported that the two sides were more than $2 million apart annually.

If the Bills and Johnson can?t work out a contract by late February, the Bills will have to decide whether to use the franchise tag to limit his mobility.? But since that would entail giving Johnson a one-year, guaranteed salary of roughly $9.5 million, the Bills likely are reluctant to make that kind of a commitment, given their apparent reluctance to pay him $7.5 million per year on a long-term deal.

Agent C.J. Laboy commented on the situation with Sal Capaccio of WGR.? ?We were approached to do a deal prior to the season starting,? Laboy said.? ?When it became clear that the two sides were too far apart, we agreed that it would be best to shelve negotiations and allow Stevie to focus on the season.? Stevie never wanted his contract status to be a distraction to him or his teammates.? At that time, the Bills turned their focus on getting [Ryan Fitzpatrick's] contract done, which they ultimately did.? A week or so after Ryan?s deal was done, the Bills wanted to re-open negotiations, but when it quickly became apparent that we wouldn?t be able to get a deal done, Stevie decided that it was best to wait until the end of the year before talking about his contract again.?

And Laboy seemed to confirm the range of Johnson?s expectations.? ?Stevie was more than willing to do a discounted deal with the Bills because of his loyalty to the organization for giving him his chance in the NFL, his loyalty to his teammates, and his love for the city of Buffalo,? Laboy said.? ?Any reports of Stevie asking for 10, 9, or even 8 million dollars a year are completely false and misleading.?

Ultimately, Johnson may have to test the market in order to determine whether someone else will offer more than what the Bills have offered, and whether Johnson is willing to leave Buffalo.

Through 15 games, Johnson has 964 yard receiving, 109 yards short of his career high in 2010.? He also has 72 catches and six touchdowns; last year, he caught 82 passes and 10 touchdowns.

But untimely drops continue to plague Johnson.? Last year, he had a game-winning score in his hands against the Steelers, but somehow dropped it.? Earlier this season against the Jets, he dropped another pass that could have delivered a win over the Jets.

Still, Johnson possesses the kind of name recognition that could prompt a receiver-needy team to overpay for his services on the first day of free agency, in order to generate offseason excitement and headlines ? and to sell tickets and jerseys.
